General Terms and Conditions – Blommers Coffee Roasters

Version 2025.1 – effective as of 1 January 2025


Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period during which the consumer may exercise their right of withdrawal.

  • Consumer: a natural person not acting for purposes related to their trade, business, craft, or profession.

  • Business customer: a natural or legal person acting in the course of their trade, business, or profession.

  • Day: calendar day.

  • Distance contract: an agreement between Blommers Coffee Roasters and the customer concluded wholly or partly through an online ordering system or other means of distance communication.

  • Product: all goods offered by Blommers Coffee Roasters, including coffee, espresso machines, coffee tools, and related items.

  • Right of withdrawal: the consumer’s legal right to withdraw from the purchase within a specified period.

  • Durable data carrier: any tool that allows the customer to store information in a way that enables future reference (such as email).

  • Entrepreneur: Blommers Coffee Roasters, hereinafter also referred to as “we” or “us.”

Article 3 – Applicability

  1. These general terms and conditions apply to every offer made by Blommers Coffee Roasters and to every distance contract concluded between Blommers Coffee Roasters and the customer (consumer or business customer).

  2. Deviations from these terms are valid only if agreed in writing.

  3. Different provisions may apply to business customers, for example concerning warranty, liability, and the right of withdrawal.

  4. The text of these terms is available electronically at www.blommers.coffee and will be provided free of charge upon request.


Article 4 – The offer

  1. The offer includes a complete and accurate description of the products offered.

  2. Images and specifications are indicative; minor variations in color, packaging, or form may occur.

  3. Errors or mistakes in the offer do not bind Blommers Coffee Roasters.

  4. All offers are non-binding and valid while stocks last.


Article 5 – The agreement

  1. The agreement is concluded when the customer confirms the order and payment has been completed.

  2. After the order is placed, the customer receives an electronic order confirmation.

  3. Blommers Coffee Roasters reserves the right to refuse an order, for example, in case of suspected abuse or payment issues.

  4. For business customers, orders become final only after written or electronic confirmation by Blommers Coffee Roasters.


Article 6 – Right of withdrawal (consumers only)

  1. The consumer has the right to withdraw from the contract within 14 days after receiving the products, without giving any reason.

  2. Exceptions (see Article 8) include perishable goods (such as freshly roasted or ground coffee) and custom-made or opened products.

  3. Within this period, the consumer must notify Blommers Coffee Roasters by email or through the withdrawal form.

  4. The consumer must return the product within 14 days after giving notice.

  5. Blommers Coffee Roasters will refund the purchase price, including delivery costs (if applicable), within 14 days after receiving the returned goods.


Article 7 – Costs in case of withdrawal

  1. The direct costs of returning the products are borne by the consumer.

  2. If the returned product is damaged or incomplete, a reduction in value may be charged.


Article 8 – Exclusion of the right of withdrawal

The right of withdrawal does not apply to:

  • Products that spoil quickly or have a limited shelf life (such as roasted coffee).

  • Opened or used products (such as coffee tools or machines showing usage marks).

  • Products that cannot be returned for hygienic reasons.

  • Business-to-business (B2B) purchases.


Article 9 – Prices

  1. All prices are stated in euros, including VAT (for consumers).

  2. Shipping costs are clearly indicated before the order is finalized.

  3. Obvious errors or mistakes in pricing do not bind Blommers Coffee Roasters.


Article 10 – Conformity and warranty

  1. Blommers Coffee Roasters guarantees that the products comply with the contract, reasonable expectations, and legal requirements.

  2. Espresso machines and electrical equipment are covered by the manufacturer’s warranty.

  3. The consumer must report visible defects within 14 days after delivery.

  4. This warranty does not apply in cases of improper use, poor maintenance, or modifications by third parties.

  5. For business customers, only the manufacturer’s warranty applies unless otherwise agreed.


Article 11 – Delivery and performance

  1. Delivery takes place at the address provided by the customer.

  2. Orders are typically delivered within 1–5 working days, unless otherwise stated.

  3. If delivery is delayed, the customer will be informed as soon as possible.

  4. The risk of loss or damage passes to the customer upon receipt of the goods.


Article 12 – Subscriptions and recurring deliveries

  1. Subscriptions can be cancelled at any time via email or through the customer account.

  2. Blommers Coffee Roasters may adjust subscription prices or terms, provided this is communicated in advance.


Article 13 – Payment

  1. Payment must be made in advance using the available payment methods (iDEAL, credit card, etc.).

  2. For business customers, payment on account may be agreed upon (payment term: 14 days net).

  3. In the event of late payment, Blommers Coffee Roasters reserves the right to charge statutory interest and collection fees.


Article 14 – Complaints procedure

  1. Complaints may be submitted within 14 days after discovery via email to [email protected].

  2. Complaints will be answered within 14 days. If more time is required, the customer will be informed within that period with an estimated resolution time.

  3. If a complaint cannot be resolved amicably, the consumer may use the European ODR platform: https://ec.europa.eu/consumers/odr.


Article 15 – Liability

  1. Blommers Coffee Roasters is not liable for any damage resulting from improper use of products or external factors.

  2. Liability is in any case limited to the amount of the invoice for the relevant purchase.

  3. For business customers, liability for consequential loss, loss of profit, or indirect damage is expressly excluded.


Article 16 – Privacy and data protection

Blommers Coffee Roasters processes personal data in accordance with the General Data Protection Regulation (GDPR).

Article 17 – Disputes

  1. All agreements and disputes are governed exclusively by Dutch law.

  2. Disputes may be submitted to the competent court in Gelderland, unless mandatory law provides otherwise.

  3. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.


Article 18 – Additional provisions

Additional or deviating provisions may not disadvantage the consumer and must be recorded in writing.
